The present terms provide the bases for selling and checking tickets, organisation of servicing passengers and loading the ferries on Kelnase - Leppneeme line.
Definitions in the present terms
Carrier – AS Kihnu Veeteed
Passenger – pursuant to the Contract of Carriage, a person travelling on the ferry
Contract of Carriage – a contract between the Passenger and the Carrier that enters into force upon the purchase of a ticket by the Passenger and on the basis of which the Carrier shall carry the Passenger and/or a vehicle to the port of destination and the Passenger shall pay the prescribed fee.
Vehicle – any car, bus, tractor, motorcycle or bicycle that is carried pursuant to the Contract of Carriage.
Hand baggage – baggage that the Passenger carries with them and that is under the Passenger’s supervision throughout the crossing, including the items located on and inside of the Passenger’s vehicle.
Crossing – with regard to the Passenger and their vehicle/goods, crossing includes the time the Passenger and/or their vehicle/goods are on board the ferry.
Scheduled voyage– a ferry voyage made by the Carrier pursuant to the schedule approved for the respective line.
Additional voyage– unscheduled ferry voyage.
Ordered voyage– a voyage ordered by a client under terms and conditions approved by the Carrier.
Ticket – a ticket purchasable on the ferry, which has a specific time of departure and a ferry line and which is paid for in cash, to a combined account of a client or by a card payment.A ticket is a document verifying concluding a Contract of Carriage and payment for it that gives a passenger and a vehicle the right for crossing. The ticket must be retained until the end of the crossing.
E-ticket is a ticket purchasable online with a specific time of departure and a ferry line, which is paid for upon ordering via Internet banking or to a combined account of a client.E-ticket is also a document verifying concluding a Contract of Carriage and payment for it that gives a passenger and a vehicle the right for crossing. The ticket must be retained until the end of the crossing.
3. Schedule of ferries
3.1 The schedule of ferries shall be compiled by the Carrier and approved by the party ordering the carriage.
3.2 Voyages carrying hazardous loads shall be performed pursuant to the rules provided for in the IMDG Code and the terms valid for the ferry.
3.3 The ferries may cancel voyages in case of wind exceeding 12 m/s and waves running higher than 1.5 m or in case other restrictions occur that are provided for in the certificates issued for the ferry or if other circumstances occur that are not dependent on the Carrier.
3.4 In case of circumstances that do not depend on the Carrier, the Carrier shall have the right to delay the departure of a ferry, change the location and time for embarking and/or disembarking the ferry without prior notice, if such circumstances do or may endanger the persons, vehicles on the ferry or the ferry itself.
3.5 The Carrier shall have the right to make crossing with another ferry than the one given in the schedule without informing the Passengers thereof, or change the route of the ferries in case circumstances occur that do not depend on the Carrier.
3.6 The crew shall inform the port, Passengers on the ferry and other interested parties of any disturbances in the schedule of the ferry.
3.7 The client service of the company shall make the information regarding disturbances available to the public not later than one hour before the ferry departs.
4. Sale and checking of tickets
4.1 Tickets are sold to all scheduled voyages and additional voyages according to the price list and procedure laid down.
4.2 The maximum permitted number of passengers and vehicles and the tonnage of the ferry are prescribed in the documents and loading instructions of the ferry and tickets shall be sold in the corresponding scope.
4.3 The ticket offices on ferries sell tickets only to the next departing ferry.
4.4 In the ticket offices located on the ferries the sale of tickets shall begin no later than 30 minutes before the ferry departs or at the first possible moment the ferry arrives to port.
4.5 E-tickets (advance sale) shall be sold via the online environment of the company www.veeteed.com.
4.6 It shall be possible to purchase e-tickets in advance within the valid schedule, but not earlier than 90 days. The Carrier shall have the right to decrease the time for purchasing e-tickets in advance.
4.7 The maximum volume of e-tickets on regular voyages shall be:
45 Passenger seats and 20 passenger seats for local people to purchase at least 24 hours before departure (unpurchased e-tickets for local people shall be sold as e-tickets 24 hours before departure)
8 line metres of vehicles or goods (max weight of 8 t)
The Carrier shall have the right to make exceptions in the scope of advance sale under an approval of the Contracting Entity.
4.8 E-ticket may be changed or cancelled by accessing the ticket via a link in the confirmation note sent to e-mail. E-tickets can be changed and cancelled up to two hours before the departure of the ferry.
4.9 In order to receive refund for cancelled e-tickets (extra-paid tickets) a form “Application for refund for cancelled e-tickets" shall be filled out on the website within seven days after cancellation. Refund shall be paid as follows:
1) 90% of the tickets’ cost if the tickets were cancelled at least 30 days before the voyage took place;
2) 75% of the tickets’ cost if the tickets were cancelled at least 14 days before the voyage took place;
3) 50% of the tickets’ cost if the tickets were cancelled at least 7 days before the voyage took place;
4) 25% of the tickets’ cost if the tickets were cancelled at least one day (24 hours) before the voyage took place.
4.10 In case of disturbances caused by weather the e-ticket shall be valid when the traffic is restored until the crossing is made, but not for longer than 24 hours after the traffic is restored (from the departure of the ferry).Tickets bought to voyages cancelled due to weather are compensated only if the client informs the client service of their wish not to use the tickets prior to restoring of traffic.
4.11 E-tickets are checked at embarking. Passengers shall submit documents permitting discount.
4.12 Embarking the ferry shall be enabled 30 minutes before the ferry departs or after the ferry arrives in port as follows: Passengers with e-tickets and local passengers in the scope of free room and thereafter persons in the general waiting line.
5. The principles of applying holding capacity of a ferry
5.1 Implementing the principle of applying holding capacity of a ferry on scheduled voyages in a regular situation:
1. Vehicles and passengers holding advance sale tickets
2. Vehicles and passengers holding valid preferential rights:
Rescue service and police vehicles with personnel on fulfilling functions;
A vehicle transporting a person with profound disability or a disabled child together with the disabled person and an attendant;
A vehicle with the driver transporting a deceased;
3. Vehicles with drivers in general waiting line;
4. Residents of Prangli Island;
5. Passengers in the general waiting line.
5.2 Implementing the principle of applying holding capacity of a ferry in emergency situations:
1. On a scheduled voyage:
1.1. Vehicles and passengers holding advance sale tickets to this voyage;
1.2. Vehicles with passengers holding preferential rights valid for the line (p 5.1.2);
1.3. Vehicles and passengers holding advance sale tickets to previous cancelled voyages;
1.4. Vehicles and passengers holding advance sale tickets to later cancelled voyages;
1.5. Vehicles with drivers in general waiting line;
1.6. Residents of Prangli island;
1.7. Passengers in the general waiting line.
2. In case of an additional unscheduled replacing voyage:
Vehicles with passengers holding valid preferential rights;
2.2. Vehicles and passengers holding advance sale tickets to previous cancelled voyages;
2.3. Vehicles and passengers holding advance sale tickets to later cancelled voyages;
2.4. Vehicles with drivers in general waiting line;
2.5. Residents of Prangli island;
2.6. Passengers in the general waiting line.
5.3. The right to use all preferential rights is valid up to 15 minutes before the ferry departs. The preferential right shall not apply upon arriving or purchasing tickets later.
5.4. Sale of tickets and loading of the ferry shall end five minutes before the ferry departs.
6. Carriage of passengers
6.1 Embarking and disembarking of the passengers on the ferry shall be indicated by persons appointed by the Carrier. In general, pedestrians embark the ferry before the vehicles are loaded and disembark after the vehicles are unloaded or alternately.
6.2 Upon embarking, passengers are guided to the rooms or deck intended for passengers.
6.3 Upon a wish of the passenger, a passenger with special needs shall be placed in the passengers’ salon or a safe part of the deck. The passenger with special need shall have free entry into and exit from a vehicle by taking into account technical aids.
6.4 Passenger with pets shall additionally adhere to the rules prescribed for carriage of pets in order to secure the safety of other passengers, the crew and the ferry. People with pets may be located only in areas of the ferry specifically marked for that purpose – pets are not allowed in the passengers’ salon (except in a carrier cage or a carrier bag).
6.5 In order to secure safety on board the ferry, the Carrier shall have the right to demand a Passenger to show the content of their vehicle and hand baggage. A passenger shall not bring items or substances on board the ferry that may endanger the ferry, persons or vehicles on the ferry. Prohibited articles include, among other things, charged, also unpackaged and unlicensed weapons; malodorous, flammable, inflammable, explosive, poisonous and other dangerous substances. If an article or a substance has been brought on the ferry without informing the Carrier of its harmfulness, the Carrier shall have the right to have the article or substance disembarked, destroyed or neutralised, depending on the situation, without any obligation to pay compensation.
6.6 During crossing passengers shall follow the orders, hand signals given by the persons in the service of the Carrier and the rules and traffic signs valid on the ferry in order to ensure order and safety and they shall adhere to these. In case of not adhering to the orders or rules the Carrier shall have the right to prohibit a passenger embarking the ferry or request the passenger to disembark the ferry. The Carrier shall have the right to refuse to carry a Passenger who is intoxicated or acts violently.
6.7 During children’s’ (students’) tours the organiser of the tour shall include sufficient number of attendants on the crossing who shall ensure behaviour that corresponds to the safety rules (not running and climbing on rails of the ferry, not damaging the fittings of the ferry).
6.8 In case of solving problems related to the carriage of passengers the captain of the ferry shall be the representative of the company.
7. Carriage of vehicles and goods
7.1 The captain of the ferry shall determine the number of vehicles and goods, the order and placement of loading for the purpose of correct stability of the ferry and more efficient use of the deck, while taking into account the needs of persons with special needs, if possible.
7.2 In case the goods are loaded with the ferry’s crane, the loading shall be finished in 30 minutes before the ferry departs, i.e. before servicing of passengers begins. While unloading goods with the ferry’s crane, it shall be taken into account that loading may begin after the passengers have disembarked the ferry and left the working area on the berth.
7.3 It is required to inform of the wish for a crossing with oversized heavy goods vehicles and in case of loading goods with a crane no later than during the previous working day.
7.4 Upon loading the vehicles on the ferry, the driver of the vehicle shall adhere to the instructions of crew members. If necessary the planned movement shall be explained to the driver prior to moving.
7.5 Passengers shall be allowed to stay in the vehicle during crossing only if they have free exit. If necessary, passengers in the vehicle shall exit the vehicle before the vehicle is placed on the ferry.
7.6 After the vehicle is placed on the ferry, the driver shall implement means to avoid any movement of the vehicle (parking brake).
7.7 If necessary, the crew shall install wheel chocks or use other fixtures pursuant to fixing instruction in order to avoid any movement of the vehicles.
7.8 The vehicles shall be located on the ferry in a manner that does not restrict passengers from moving to gathering spots and it is possible, if necessary, to fasten additional fixtures and operate in case of fire.
7.9 The Carrier shall not be obligated to carry a vehicle that is not in a good technical condition or is environmentally hazardous (incl. leaking, has no breaks, exceed permitted loading capacity).
7.10 In order to avoid contamination and unpleasant odour from reaching the deck, any respective loads (live animals, fish, garbage etc.) shall be transported by special vehicles or packaging that is in a good technical condition.
7.11 Any cases on board the ferry during which the ferry, passengers, goods or vehicles on board the ferry are damaged or injured shall be recorded in a report.
7.12 The captain of the ferry shall be the representative of the company in solving cases and gathering information on site.
8.1 The Carrier shall not be liable for the passengers’ baggage and its content being lost, destroyed or spoilt.
8.2 The Carrier shall not be liable for safekeeping or damaging of any unattended hand baggage, goods loaded on car deck and load located in the vehicles.
8.3 The Carrier shall be liable in case of delayed and cancelled voyages:
8.3.1 Pursuant to the provisions in Regulation No. 1177/2010 of the EU that covers the rights of Passengers travelling by sea and inland waterways;
8. 3.2 Pursuant to the provisions in the contract of public servicing.
8.4 The driver of the vehicle shall be liable for adhering to the requirements of the present terms (incl. following the orders and hand signals of the persons in service of the Carrier and following the markings in ports and on the ferry), also for suitable technical condition, fastening, covering or loading of the vehicle or its load and for submitting accurate data to the Carrier.
8.5 All damages caused to port facilities, the ferry, the environment or to the health and/or property of third persons due to ignoring the said terms shall be covered by the person causing the damage.
8.6 Any damages arising from contamination to the ferry, third persons or the environment shall be covered by the driver of the vehicle or owner of the cargo.
8.6.1 In case of discovering contamination on the deck of the ferry a report shall be filled out that shall record the volume and producer of the contamination and costs for eliminating the contamination, which shall be covered by the producer of the contamination. Costs of eliminating contamination shall be calculated on the basis of the volume of the contamination and price of a square metre – EUR 10.
8.7 A Passenger shall inform the Carrier of any damages caused to them, goods or vehicle during the crossing or immediately after it is made. In case the passenger does not follow the requirement in the present clause, it shall be presumed that the crossing was made without damaging the passenger, the vehicle or the goods.
8.8 The Carrier shall be liable for injuries caused to the passenger, damages to and destruction of the vehicle in case such injury, damage or destruction was caused due to the Carrier’s fault or negligence.
